This Privacy Policy does not apply to our Subscribers' collection or use of Personal Information through our Services or otherwise. Callers should contact the business they called for privacy support.
This Privacy Policy does not apply to data collected by third parties, including our Subscribers. Agentic Era, LLC provides the Services to our Subscribers, and each Subscriber determines how it will use the data collected from their Callers and other customers through the Services. Any processing of data by Agentic Era, LLC to train or develop AI technologies is governed by contracts with our Subscribers, not this Privacy Policy.
Each Subscriber is responsible for their own Personal Information collection and storing or processing that data on the Services. This includes AI Phone Assistant functionality, privacy settings, data management, providing notice and obtaining consent from Callers, and responding to Callers' privacy inquiries. Callers should contact the Subscriber with any questions about their Personal Information on the Services.
We collect "Non-Personal Information" and "Personal Information." Non-Personal Information includes information that cannot be used to personally identify you, such as anonymous usage data, general demographic information we may collect, referring/exit pages and URLs, platform types, preferences you submit and preferences that are generated based on the data you submit and number of clicks.

Note that information may not be protected by privacy laws if it is: (i) publicly available, (ii) aggregated, meaning data about a group from which individual identities have been removed, or (iii) deidentified so that it cannot be easily linked back to the individual.
To activate the Service you do not need to submit any Personal Information other than your email address. To use the Service thereafter, you do not need to submit further Personal Information. However, in an effort to improve the quality of the Service, we track information provided to us by your browser or by our software application when you view or use the Service, such as the website you came from (known as the "referring URL"), the type of browser you use, the device from which you connected to the Service, the time and date of access, and other information that does not personally identify you. We track this information using cookies, or small text files which include an anonymous unique identifier. Cookies are sent to a user's browser from our servers and are stored on the user's computer hard drive. Sending a cookie to a user's browser enables us to collect Non-Personal information about that user and keep a record of the user's preferences when utilizing our services, both on an individual and aggregate basis. For example, the Company may use cookies to collect the following information:
· Usage patterns, page views, browser type, referring site, time spent on site, and other standard analytics data
The Company may use both persistent and session cookies; persistent cookies remain on your computer after you close your session and until you delete them, while session cookies expire when you close your browser. When a Subscriber registers to use our Services, we collect information about their business, like name, email, phone, and other identifiers to create and facilitate their account and use of the Services. We also collect any information a Subscriber submits to the Services, such as account profile information, employee identifiers, and communications related to the Subscriber's use of our Services.
Subscribers authorize us to collect data from the Subscriber's website, online reviews, and other data sources to train the Subscriber's AI Phone Assistant. A Subscriber may also choose to link the Services with their customer relationship management software ("CRM"), calendars, or other software. If so, we will access this information to provide enhanced Services as requested by the Subscriber.
By registering, you are authorizing us to collect, store and use your information in accordance with this Privacy Policy. The Subscriber is solely responsible for ensuring they are authorized to share Personal Information with us for any purpose.
Our AI Phone Assistant collects Personal Information from Callers on behalf of our Subscribers. We may collect contact information or other identifiers of a Caller contacting a Subscriber and the contents of the Caller's message.
Callers may include Personal Information in their conversations with a Subscriber's AI Phone Assistant. The AI Phone Assistant will use this information to generate requested information or other outputs, such as setting appointments or sending reminders.
The AI Phone Assistant technology collects and analyzes the Caller's voice to understand and process requests and to detect when different responses or human intervention may be necessary.
When a Caller interacts with an AI Phone Assistant, their interactions may be accessible to us or our third-party service providers simultaneously and in real time. By interacting with an AI Phone Assistant, Callers consent to this access. If a Caller does not consent to such access, they should not interact with the AI Phone Assistant.
Calls with AI Receptionists are recorded for quality assurance, to improve the Services, and for other internal business purposes. Call recordings are used to generate transcripts of conversations and support our Subscribers' use of our Services.
If you are a Caller, the AI Phone Assistant will notify you if a call is being recorded. By staying on the line after receiving the notification, you consent to the call recording. If you do not consent to call recording, you may end the call or ask to not be recorded.
Call recordings and transcripts are necessary for our Services to function. Deidentified data from call recordings and transcripts may be used to understand interactions, train our AI technology, or improve the Services.
Call recordings, transcripts, and other data from calls belong to the Subscriber, not Agentic Era, LLC. Each Subscriber determines how data is used and how long it is retained. Please contact the Subscriber you called if you have questions about call recordings.
Agentic Era, LLC never collects, stores, or processes payment information. We charge Subscribers subscription fees and sometimes facilitate payments from Callers to Subscribers as a Services feature, but we always use a PCI-DSS compliant payment processor to collect, process, and store payment information, subject to the payment processor's policies and terms.

The Site does not knowingly collect or solicit information from anyone under the age of 13, or allow anyone under the age of 13 to sign up for the Service. In the event that we learn that we have gathered personal information from anyone under the age of 13 without the consent of a parent or guardian, we will delete that information as soon as possible. If you believe we have collected such information, please contact us at privacy@agenticerallc.com.
Each Subscriber is responsible for using the Services in a manner that prevents children from providing their Personal Information. If a Subscriber permits children to provide Personal Information through the Services, that Subscriber does so according to its own privacy practices, not ours.
Except as otherwise stated in this Privacy Policy, we do not sell, trade, rent or otherwise share for marketing purposes your Personal Information with third parties without your consent. We do share Personal Information with vendors who are performing services for the Company, such as the servers for our email communications who are provided access to user's email address for purposes of sending emails from us. Those vendors use your Personal Information only at our direction and in accordance with our Privacy Policy.
In general, the Personal Information you provide to us is used to help us communicate with you. For example, we use Personal Information to contact users in response to questions, solicit feedback from users, provide technical support, and inform users about promotional offers.
We may share Personal Information with outside parties if we have a good-faith belief that access, use, preservation or disclosure of the information is reasonably necessary to meet any applicable legal process or enforceable governmental request; to enforce applicable Terms of Service, including investigation of potential violations; address fraud, security or technical concerns; or to protect against harm to the rights, property, or safety of our users or the public as required or permitted by law.
We may also use Personal Information to: (i) provide, administer, maintain, improve, or analyze the Services; (ii) communicate with Subscribers or others; (iii) develop new Services, products, or features; (iv) prevent fraud, criminal activity, or misuse of the Services, and protect the security of our information systems; (v) comply with legal obligations or protect our rights and the rights of others, or (vi) support or carry out a business transition or transfer.
In general, we use Non-Personal Information to help us improve the Service and customize the user experience. We also aggregate Non-Personal Information in order to track trends and analyze use patterns on the Site. This Privacy Policy does not limit in any way our use or disclosure of Non-Personal Information and we reserve the right to use and disclose such Non-Personal Information to our partners, advertisers and other third parties at our discretion.
In the event we undergo a business transaction such as a merger, acquisition by another company, or sale of all or a portion of our assets, your Personal Information may be among the assets transferred. You acknowledge and consent that such transfers may occur and are permitted by this Privacy Policy, and that any acquirer of our assets may continue to process your Personal Information as set forth in this Privacy Policy. If our information practices change at any time in the future, we will post the policy changes to the Site so that you may opt out of the new information practices. We suggest that you check the Site periodically if you are concerned about how your information is used.
We may de-identify or aggregate any Personal Information or other data input to or collected through the Services. De-identified and aggregated data is not Personal Information, and we will not attempt to reidentify it with any consumer except as required by law. We may use this data to analyze the effectiveness of the Services or improve the Services, such as to train our language learning models, improve or add features, or for research or related purposes. We reserve the right to disclose aggregated and de-identified data to third parties without limitation.
As a service provider to our Subscribers, we retain Personal Information about Callers until the Subscriber deletes it or instructs us to do so. Subscriber account information is retained while the account is active. We delete Subscriber account data 30 days after the Subscriber's subscription is cancelled. Subscribers may retain Personal Information collected through the Services for different retention periods, subject to the Subscriber's privacy practices.
Personal Information on our marketing lists is retained until you opt out or we determine that the information no longer serves our business purposes. For example, if you have never been a Subscriber and you do not interact with the marketing content we send you for two years, we will remove your Personal Information from our marketing lists.
When we no longer have a business need for your Personal Information, we will either delete, de-identify, or anonymize it whenever feasible. Where not feasible (such as data in our backup archives) we will securely store it and keep it isolated from further processing until it can be permanently deleted.
We implement security measures designed to protect your information from unauthorized access. Your account is protected by your account password and we urge you to take steps to keep your personal information safe by not disclosing your password and by logging out of your account after each use. We further protect your information from potential security breaches by implementing certain technological security measures including encryption, firewalls and secure socket layer technology. However, these measures do not guarantee that your information will not be accessed, disclosed, altered or destroyed by breach of such firewalls and secure server software. By using our Service, you acknowledge that you understand and agree to assume these risks.
All data is securely stored in a cloud environment and encrypted using industry-standard encryption. Our personnel are required to follow security protocols and are trained to handle sensitive data. Data and systems are subject to regular backups and audits. Our service providers are contractually bound to adhere to the same security protections.
You have the right at any time to prevent us from contacting you for marketing purposes. When we send a promotional communication to a user, the user can opt out of further promotional communications by following the unsubscribe instructions provided in each promotional e-mail. You can also indicate that you do not wish to receive marketing communications from us in the Settings section of the Site. Please note that notwithstanding the promotional preferences you indicate by either unsubscribing or opting out in the Settings section of the Site, we may continue to send you administrative emails including, for example, periodic updates to our Privacy Policy.
